Basics of Equitable Distribution of Property
In the cases of divorce, legal separation and dissolution of marriage, the spouses need to have their assets distributed. The equitable distribution of property does not mean that both the partners will have equal number of assets. The term “equitable distribution of property” suggests “fairness”, which means that the court decides the distribution of assets in a way that is fair to both the parties.
Separate assets and marital assets
The assets that are to be divided after a separation in equitable distribution are the ones that the spouses acquired during the marriage period and not the ones acquired before the marriage. All the combined assets including the physical and financial ones are to be divided between the two. These include dividends, savings, cars, estates etc.

In 2004, a judge in Toronto refused to grant a divorce to a couple who were of the same sex. The judge claimed that the ground for this refusal was that the divorce laws were only applicable to those who according to the Divorce Act were a man and a woman married to each other. This Canadian couple were married on June 18, 2003 but had separated five days later. The lesbian couple has been living together for 10 years before their nuptials. Later that year a higher court in Canada overruled the decision made by the earlier courts. This marked the first same-sex divorce in Canada and the world.
